INTRODUCTORY PROVISIONS

General

The General Terms and Conditions of the REVIVUS online store (hereinafter: General Terms) are drafted in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-2), the General Data Protection Regulation (GDPR), and the Electronic Communications Act (ZEKom-1). They apply to the operation and use of the REVIVUS online store and the website [https://revivus.eu/], and define the rights and obligations of users of the REVIVUS online store / purchasers of REVIVUS jewellery and the seller of REVIVUS jewellery.
The General Terms and Conditions are published on the website: https://revivus.eu/.
The REVIVUS online store (hereinafter also: online store) is operated by the company BVG d.o.o. Kranj, Savska cesta 16, 4000 Kranj, registration number: 5307562000 (hereinafter: BVG), which is also the provider of online sales on https://revivus.eu/ and the manufacturer and supplier of the goods sold in the online store.

Definitions

The terms used in these General Terms have the following meanings:
provider: the manufacturer of REVIVUS jewellery – BVG d.o.o. Kranj, Savska cesta 16, 4000 Kranj;
user: any visitor to the website https://revivus.eu/;
orderer: a user who places an order for the purchase of REVIVUS jewellery (hereinafter also: products or goods) via the REVIVUS online store;
order: an offer submitted by the orderer to conclude a sales contract between the provider and the orderer for the purchase of products from the online store;
buyer: the orderer whose order has been confirmed by the provider via email. Upon receiving the confirmation email, a sales contract for the purchase of the selected products is concluded;
products: REVIVUS jewellery.

Availability of Information

The provider undertakes to always provide users and buyers with the following information:
a) the identity of the manufacturer and seller of the jewellery (company name, registered office,registration number);
b) contact details enabling fast and effective communication (email, telephone);
c) essential characteristics of the goods or services (including after-sales services and warranties);
d) product availability (each item in the online store should be available within a reasonable period);
e) delivery conditions (method, place, and time of delivery);
f) clearly and unambiguously stated prices, including whether they include VAT and delivery costs;
g) methods of payment and delivery;
h) the period of validity of the offer;
i) the deadline and conditions for withdrawal from the contract;
j) explanation of the complaint procedure, including contact details of the responsible person or customer service.

Validity and Application of the General Terms

Users of the REVIVUS online store are bound by the General Terms valid at the time of using the REVIVUS website, and buyers are bound by the General Terms valid at the time of placing their order.
Before confirming an order, the user is expressly notified of the General Terms and must confirm that they have read and understood them.

USE OF THE REVIVUS ONLINE STORE

The REVIVUS online store operates 24/7. However, due to technical or other issues, access or operation may occasionally be unavailable. The provider reserves the right to:
temporarily or permanently limit or suspend the sale of some or all products in the online store,
temporarily or permanently limit or suspend access to the website.

The provider reserves the right to modify website content and the General Terms at any time without prior notice. Continued use of the website is considered acceptance of the amended terms.

The provider assumes no responsibility for any consequences arising from the use of website content or any potential errors, incomplete information, or viruses. The provider is not liable for hardware or software malfunctions occurring during the use of the website.

The provider and any party involved in the creation of the website shall not be held liable for damages arising from the use or inability to use the website or from errors or omissions in its content.

The provider may include links to external websites but does not assume responsibility for their content.
Website content may be used only for personal, non-commercial purposes. Any other use—copying, reproducing, distributing, publishing—is prohibited without the provider’s written consent.

ONLINE STORE OFFER

The products displayed in the online store represent part of the provider’s product range.

The provider reserves the right to change product descriptions and correct any errors without prior notice. Product images are symbolic and may not fully represent the actual characteristics (especially size and color), which may vary depending on the user’s device settings.

PRICES, PAYMENT AND STOCK

All online store prices include VAT and are expressed in EUR. Prices apply exclusively to online purchases and may change without notice. The price valid at the time of placing the order is binding.

Delivery costs are not included in product prices; they are shown separately before the order is completed. The invoice lists the total value of the purchased products and delivery cost.

Special or promotional offers apply only within the specified timeframe.

Availability data on the website are informative and may not reflect real stock. The provider may cancel an order if the product is out of stock. Products remain the property of the provider until paid in full.

PURCHASE OF PRODUCTS IN THE REVIVUS ONLINE STORE

For legal entities, purchasing products directly through the REVIVUS online store is currently not possible. Legal entities may purchase products from the REVIVUS online store via email: info@revivus.eu.

Purchasing in the online store is done by the user selecting the desired product by clicking the “add to cart” button.

The user may remove selected products from the cart, increase their quantity, or continue shopping. In the next stage of the purchase, the user is shown the buyer’s details and the information on where the ordered products are to be delivered. The user then selects the payment method. The user also has a dedicated field to enter any wishes or comments related to the order. Before completing the order, the user confirms that they agree with the General Terms and Conditions and the Privacy Policy and completes the purchase by clicking the “confirm order and payment” button. If the user does not agree with the General Terms and Conditions and the Privacy Policy, placing the order is not possible. Before placing the order by clicking the “confirm order and payment” button, the user has the option to review the order once more, including details of the selected items, their quantity and price, shipping/delivery costs and taxes, i.e., the total cost of the order, and modify the order if necessary.

After placing the order, the system notifies the user that the purchase has been completed. The user will receive an email confirmation of order submission at the email address provided when placing the order. The submitted order is binding for the user in its entirety.

When the provider processes the order, the buyer receives an email confirming the order, at which point a sales contract for the ordered products is concluded between the user (from that moment on referred to as the buyer) and the provider. Together with the confirmation message, the buyer also receives a link to the General Terms and Conditions and the Privacy Policy. In this email, the provider informs the buyer about where to send any comments, claims, or statements, and instructs the buyer on the right of withdrawal from the contract.

After the order has been placed, the provider sends the buyer all up-to-date information regarding the status of the order (dispatch date, changes in delivery time, completion of purchase, etc.) and the invoice by email.

The concluded sales contract between the buyer and the seller (provider), as well as copies of invoices, are archived at the provider’s headquarters.

By confirming the purchase in the REVIVUS online store, the buyer confirms that:
– they are at least 18 years old,
– they are familiar with the General Terms and Conditions of the REVIVUS online store and the Privacy Policy and understand their content and meaning,
– they are familiar with the provisions of consumer protection and personal data protection regulations,
– they have provided accurate information enabling the provider to correctly process the order and deliver it to the selected address, and that they assume responsibility for any incorrect information and resulting damage,
– they will immediately notify the provider of any errors detected in the execution of the order (e.g., typographical errors in the order submission or confirmation email, especially an incorrectly entered delivery address or item) or in the products.

PACKAGING AND DELIVERY

Packaging

Before shipping, the provider carefully packs all products into a delivery box. All products are undamaged, thoroughly inspected, and in their original packaging before being packed. The provider includes a card with a QR code with the ordered products, through which the buyer can access the revivus.eu website, where information on the characteristics of the purchased products, their use, maintenance instructions, manufacturer’s recommendations, warnings, and other necessary and important information is available.

Delivery

In the REVIVUS online store, the user may select the address to which the ordered products should be delivered: the customer’s address or another address.

Ordered products will be delivered to addresses in the Republic of Slovenia by Pošta Slovenije d.o.o., Slomškov trg 10, 2500 Maribor, and to foreign delivery addresses by DHL Express (Slovenia) d.o.o., Špruha 19, 1236 Trzin.

Delivery within the Republic of Slovenia usually takes place on the next working day after dispatch, typically within three working days. Orders are usually shipped within two working days after order confirmation, provided that the purchase price has been paid in full.

If delivery is unsuccessful or if the buyer is absent at the time of delivery, the delivery service will leave a notice of an unsuccessful delivery attempt. The buyer may then contact the delivery service to arrange a new delivery or pick up the package at the nearest post office or parcel locker of Pošta Slovenije/DHL Express.

The total delivery time usually ranges from 4 to 15 working days, with the first attempted delivery to the address provided by the buyer considered as the delivery date. For products that are temporarily out of stock, the delivery time will be extended accordingly, and the buyer will be notified by email. If the buyer does not agree with the revised delivery time, they have the right to immediately withdraw from the order or sales contract.

If multiple products have been ordered and some are in stock while others are not, the provider will perform a partial delivery, meaning that products will be shipped to the buyer based on stock availability unless the user indicates during or after placing the order that they wish to receive all products in a single shipment. Shipping costs for partial deliveries are charged only once for the entire order, regardless of the number of deliveries.

Damages incurred by the buyer due to the loss or destruction of the shipment during transport cannot exceed the value of the order.

The carrier is responsible for damages occurring during transport. If, upon receiving the shipment, the buyer notices that the package is physically damaged or shows signs of opening, or if other indications suggest that the products inside the packaging may be damaged, they must immediately initiate a complaint procedure with the provider. The provider recommends that the buyer photograph the unopened damaged packaging and the damaged product.

Delivery Costs

Delivery costs within the Republic of Slovenia

The delivery fee within the Republic of Slovenia is EUR 4.99.
The delivery cost is calculated automatically when placing an order and is included in the final price.

Whether the delivery cost is paid by the user or the provider depends on the order value:
– when the order value (excluding delivery costs) is up to and including EUR 49.99, the delivery cost is paid by the buyer,
– when the order value (excluding delivery costs) is EUR 50.00 or more, the delivery cost is paid by the provider.

Delivery costs abroad

The delivery fee for EU countries and non-EU Balkan countries (Albania, Serbia, Bosnia and Herzegovina, Kosovo, Montenegro, North Macedonia) is EUR 11.99.

The delivery fee for all other countries is EUR 19.99.

The delivery cost is calculated automatically when placing an order and is included in the final price.
Whether the delivery cost is paid by the user or the provider depends on the order value:
– when the order value (excluding delivery costs) is up to and including EUR 119.99, the delivery cost is paid by the buyer,
– when the order value (excluding delivery costs) is EUR 120.00 or more, the delivery cost is paid by the provider.

BUYER’S RIGHT TO WITHDRAW FROM THE CONTRACT

For contracts concluded at a distance or outside business premises, the buyer has the right to notify the provider within 14 days that they are withdrawing from the contract, without needing to state the reason for the decision. The withdrawal period begins on the day the buyer acquires actual possession of the products purchased in the REVIVUS online store. The buyer bears the cost of returning the products purchased in the REVIVUS online store.

The buyer may exercise the right of withdrawal in one of the following ways:
– if the buyer has not yet received the products ordered in the REVIVUS online store, they may withdraw from the contract by notifying the provider of the withdrawal via email at: info@revivus.eu. Completing any form is not required in this case – the user states their first and last name, delivery address, order number, and declares that they are withdrawing from the contract;
– if the buyer has already received the products ordered in the REVIVUS online store, they may withdraw from the contract by sending the product together with the original packaging (i.e., the packaging in which the product was received) back to the provider within the 14-day return period, to the following address: BVG d.o.o. Kranj, Savska cesta 16, 4000 Kranj. The buyer must return the products unworn, unused, undamaged, in their original packaging, and with all included components. The returned product must be accompanied by a completed WITHDRAWAL FORM (available at this link). The buyer returns the products to the provider via a registered postal service or registered courier service. The cost of returning the products purchased in the REVIVUS online store is borne by the buyer.

In the event of withdrawal from the contract, the provider will refund the purchase price for the returned products to the buyer no later than 14 days after receiving the returned product. The provider will refund the purchase price using the same payment method as used by the buyer when paying the purchase price.

COMPLAINTS

What is not subject to complaint

All products are inspected before delivery and shipped undamaged.

For REVIVUS products and jewelry, variations in shape and color are possible. Each product is therefore unique. Variations in color and shape do not constitute grounds for a complaint. Since these are individual products, color shades may slightly differ from item to item, as may other components, and these differences are not subject to complaint.

Accidental wear is not subject to complaint. Scratches and physical damage caused by the buyer (broken necklace/bracelet, bent ring resulting in magnet loss), improper use or storage of jewelry, contact with household chemicals, makeup, perfumes, discoloration of stones due to water, chemicals, sweat, makeup, loss of magnets due to daily wear, and natural inclusions and imperfections on magnets and jewelry are also not subject to complaint.

In case of an error on the part of the provider

If the delivered products do not correspond to the characteristics or specifications of the ordered products, the buyer must notify the provider within 8 days from the date of receipt of the product. The buyer must return the product within these 8 days in its original packaging and in the condition in which it was received. The buyer must attach a completed Complaint Form, accessible at this link. The user may also request the Complaint Form by emailing: info@revivus.eu.

The user returns the product in its original packaging together with the completed Complaint Form via a registered postal service or registered courier service to the provider’s address: BVG d.o.o. Kranj, Savska cesta 16, 4000 Kranj. The provider bears the cost of returning products that are returned due to a complaint.

If the complaint is justified, the buyer has the right to select another product from the REVIVUS online store, request a credit note, or request a refund.
If the complaint cannot be resolved immediately due to a product defect, the provider will prepare a complaint report and send the product for analysis, which will confirm or deny the reasons for the complaint. The provider covers the cost of analysis only if the complaint is justified; otherwise, these costs are borne by the buyer.

MATERIAL DEFECTS

What is a material defect
The provider is liable for material defects on products that appear within two years from the date the product was delivered to the buyer.

A material defect exists if:
the item does not have the properties necessary for its normal use or for placing it on the market;
the item does not have the properties necessary for the specific use for which the buyer purchased it, and which was known or should have been known to the seller;
the item does not have the qualities and features explicitly or implicitly agreed upon or prescribed;
the seller delivers an item that does not match the sample or model, unless the sample or model was shown only for informational purposes.

Exercising rights based on material defects

The buyer may exercise their rights based on a material defect if they notify the provider of the defect within two months from the day the defect was discovered (defect notification). In case of a material defect, the buyer completes a Defect Notification Form, accessible at this link. In this form, the buyer must describe the defect precisely.

The buyer returns the product in its original packaging along with the completed Defect Notification Form via a registered postal service or registered courier service to the provider’s address: BVG d.o.o. Kranj, Savska cesta 16, 4000 Kranj. The provider bears the cost of returning products that are returned due to a material defect complaint.

Upon receiving the product, the provider will verify the actual existence of the defects stated in the Defect Notification and will notify the buyer in writing of the findings within 8 days of receiving the product and the Defect Notification.

A buyer who has properly notified the provider of a defect, and for which the provider has determined that it is justified, is entitled to request that the provider:
– rectify the defect, or
– refund part of the paid amount in proportion to the defect, or
– replace the defective product with a new, flawless one, or
– refund the full paid amount.

These rights expire two years after the day the buyer notified the provider of the material defect.

RESERVATIONS AND EXCHANGES OF ORDERED AND DELIVERED PRODUCTS

Reserving products from the REVIVUS online store without placing an order is not possible. By submitting an order, the user reserves the ordered product for the period from order submission until withdrawal from the contract/delivery of the ordered products. When a product is out of stock, it cannot be ordered (the order form for that product will be temporarily disabled).
Exchanging ordered and delivered products for other products from the REVIVUS online store is not possible.

The buyer may perform an exchange of ordered and delivered products only by withdrawing from the contract in accordance with Section 7 – BUYER’S RIGHT TO WITHDRAW FROM THE CONTRACT, and then placing a new order in the REVIVUS online store for the desired product.

PRIVACY PROTECTION

At BVG d.o.o., the personal data of users and buyers is secure, and the provider will handle the data strictly in accordance with applicable personal data protection regulations. All personal data provided when placing an order will be used exclusively for fulfilling orders and for any necessary communication to ensure successful operations, unless the user/buyer has specifically consented to any other form of personal data processing.

The transmission of sensitive personal and transactional data in the online store is performed securely using the TLS (HTTPS) protocol, whose security is ensured by an SSL/TLS certificate issued by a trusted certification authority and by payment service providers (Stripe, PayPal).

The user’s/buyer’s personal data for the purpose of notifications about new or changed services or products, special offers, prize games, useful information about the provider’s services or products, preparation of individualized/personalized offers, or other marketing activities will be used only with the user’s/buyer’s explicit consent. This consent is not a condition for completing a purchase in the REVIVUS online store.

DISPUTE RESOLUTION

The provider will strive to resolve disputes arising from the operation of the REVIVUS online store amicably and promptly, in accordance with consumer legislation and good business practices.

In accordance with the Act on Out-of-Court Settlement of Consumer Disputes, the buyer has the option of online out-of-court dispute resolution at the following link:

However, the provider does not recognize any out-of-court consumer dispute resolution provider.

The REVIVUS online store, together with all associated data and images, is protected by copyright law and may not be copied, distributed, altered, reproduced, or used in any way without the provider’s prior written consent.
